Family gets giant settlement from medical malpractice claim
The worst nightmare a parent could have is that their child gets sick or is injured. Making it worse is when the injury is caused by people who are supposed to be helping the child -- medical professionals. While many parents may choose to file suit in the wake of a medical malpractice case, few are awarded as much as one family was recently.
The case involved a 4-year-old girl who had undergone a heart transplant shortly after birth. While this condition caused her setbacks, she was basically a normal and healthy girl by the time she came down with a cold and her parents consulted with her cardiologists to determine her treatment.
Unfortunately, there was a miscommunication between two of the girl's doctors. The girl was mistakenly given a prescription for a nasal spray that ended up affecting her breathing. She ended up suffering brain damage as a result.
That was five years ago. Since then, and for the rest of her life, the girl will require constant medical care; she cannot walk, talk or even swallow on her own.
A judge agreed with the family that the hospital and doctors were negilgent. Though the hospital apologized for its mistake, the judge in the case ordered that the family receive $15.2 million as a result.
